NDIS Service Agreements Explained

Whilst in most cases a service agreement is not a legal requirement, providers should support each participant to understand any service agreement using the language, mode of communication and terms that the participant can understand.
The NDIS recommends having a written service agreement so participants and providers are clear about what each party has agreed to. They are also helpful to get a better understanding of how much funding will likely be needed for each support across the plan period.
Making a service agreement is a negotiation between participant and provider. You are allowed to have someone to help you with this negotiation (such as a family member or friend).
It is a requirement to have a Service Agreement for Specialist Disability Accommodation, but you do not need to have one for other providers. However, it is recommended best practice that you do have one with each provider. Service agreements help make sure the participant and provider have the same expectations of what supports or services will be delivered and how they will be delivered.

Things to consider
- What supports are being provided
o What day and time will the service be provided
o Is it a regular or one-off service
o If it is for a capacity building support does the provider hold the required qualifications (where applicable)
- What is the cost
o Are there travel costs included
o Are all fees and charges included
o Will GST be charged
o Who will pay for the support (plan manager, agency or self)
- Does it have a clear cancellation policy
- Does it outline the responsibilities of both provider and participant
- Is it in a language and format that is easy to understand
- How long does it go for (a service agreement doesn’t have to be for the entire plan period)
- How do I end the service agreement
